Terms of use

1.Scope and acceptance

These terms govern the Photress iPhone app, photress.com and related support provided by Individual Entrepreneur Gleb Kucherenko, Georgia, identification number 347013670. By downloading or using Photress, you agree to these terms. Mandatory consumer rights in your country continue to apply and override any conflicting provision.

2.App licence

Photress grants you a personal, limited, non-exclusive, non-transferable and revocable licence to use the app on Apple devices you own or control, subject to these terms and Apple’s usage rules. Photress is licensed, not sold; no ownership of the software or brand is transferred to you.

3.Your files remain yours

You keep all rights in photos, videos and other content you import. Photress does not claim a licence to use that media, does not upload it to a developer server and does not use it to train models, advertise or profile you.

You are responsible for having the right to store, export and share the content you place in Photress.

4.App Code, backup passphrase and Recovery Key

The device-local App Code is a convenience for opening the library on that iPhone. It does not unlock a copied backup. A portable backup uses a separate backup passphrase or 24-word Recovery Key.

Photress cannot recover credentials that you lose and has no master key. Keep at least one portable credential outside the iPhone, do not email it to Photress and confirm that you can restore before relying on a backup.

5.Backups and storage destinations

You choose where a backup package is written: iCloud Drive, a Files provider, local device storage or compatible external storage. Photress cannot guarantee a provider’s availability, remote upload, capacity or future compatibility.

A completed local write is not the same as a confirmed cloud upload, an integrity check or a tested restore. You remain responsible for maintaining access to the destination and for keeping enough independent, verified copies for your needs.

6.Free and Pro

Free permits adding up to 200 logical media items. Pro Annual and Pro Lifetime unlock the creation and expansion features described in the App Store listing. One Live Photo counts as one logical item and one video counts as one item regardless of size.

Viewing, exporting, restoring, making an emergency backup, deleting and accessing already stored Primary or Decoy data do not depend on an active subscription. Entitlements may limit new creation or expansion, not decryption or retrieval of existing data.

7.App Store purchases, trial and refunds

Apple processes all purchases. Prices, taxes, currency and eligibility are shown by the App Store for your region. A Pro Annual subscription renews automatically unless cancelled through your Apple account before renewal. Any offered trial follows the terms displayed by Apple; at launch the planned trial is 14 days.

Billing, cancellation and refund requests are handled by Apple under the Apple Media Services terms. Pro Lifetime is a one-time entitlement for the current Photress product; it is not a promise that the app, operating systems or third-party services will exist forever.

8.Acceptable use

Do not use Photress unlawfully, violate another person’s rights, distribute malware, bypass entitlement checks, interfere with security mechanisms or reverse engineer the app except where applicable law expressly permits it. You must not use support or security channels to send abusive, illegal or needlessly sensitive material.

9.Apple and third-party providers

Apple, iCloud Drive, Files providers and external-storage vendors are independent services governed by their own terms. Their outages, account restrictions, sync behaviour, file eviction or hardware failures are outside Photress’s control. Links on the website do not amount to an endorsement or warranty of a third party.

10.Updates, compatibility and availability

We may update Photress to improve security, compatibility or features, and may discontinue an obsolete version when reasonably necessary. Changes to backup formats must remain versioned and compatible with the documented recovery path. Some features depend on supported iOS versions, hardware, Apple frameworks and compatible storage providers.

We aim to give reasonable notice of material changes, but urgent security or platform updates may require faster action.

11.Security, warranties and liability

Photress is designed to reduce specific privacy and recovery risks; it cannot eliminate every risk. Encryption does not protect against every compromised device, exposed credential, destructive user action or unavailable destination.

To the fullest extent permitted by law, Photress is provided without warranties beyond those expressly stated, and the operator is not liable for indirect or consequential loss caused by circumstances outside reasonable control. Nothing in these terms excludes liability or statutory remedies that cannot legally be excluded, including mandatory consumer rights.

12.Ending use and access to existing data

You may stop using Photress and delete the app at any time. Deleting the app may remove its local encrypted library; confirm a usable backup first. If a paid entitlement expires or is cancelled, access to existing data, export and restore remains available as described above.

We may restrict access to future services for serious misuse, but cannot remotely decrypt or delete a library that exists only on your device or selected storage.

13.Governing law and disputes

These terms are governed by the laws of Georgia, without removing mandatory protections or forum rights available to consumers under the law of their residence. Please contact support@photress.com first so we can try to resolve a concern. A dispute that cannot be resolved is handled by the competent court determined under applicable law.

14.Changes and contact

Material revisions will be posted with a new date and, where required, presented before they take effect. Continued use after an effective revision means acceptance only to the extent allowed by applicable law. Questions about these terms may be sent to support@photress.com.
